 No - the community edition version 5.0.38 can be built using source code downloaded from  ftp://ftp.mysql.com/pub/mysql/src/ ,
 as discussed at www.apachelounge.com/viewtopic.php?t=1231 .
 
 It is based on the Enterprise server (i.e. it is the same source code as Enterprise)
 - but when it is built from source code this way, it is licensed as the community edition (i.e. GPL v2), so it can be freely distributed.
